Data protection rights
What data protection rights do you have as a data subject?
As a data subject, you have the following rights at all times:
- Information, correction, deletion or restriction of the processing of your stored data (after clear identification via a valid identification document).
- Object to the processing and use for direct marketing purposes.
- Data portability in accordance with the requirements of data protection law.
Right to confirmation
As a data subject, you have the right to request confirmation from us (after you have been clearly identified by means of a valid identification document) as to whether personal data relating to you is being processed by us. You can contact us at any time at office@annabergerlifte.at.
Right to information
As a data subject, you have the right to receive from us at any time, free of charge, information about the personal data stored about you and a copy of this information (after clear identification via a valid identification document). You can contact us at any time at office@annabergerlifte.at.
Your right of access includes the following information:
- the purposes of processing,
- the categories of personal data that we process,
- the recipients or categories of recipients to whom the personal data have been or will be disclosed,
- if possible, the planned duration for which your personal data will be stored or, if this is not possible, the criteria for determining this duration,
- the existence of your right to have personal data concerning you rectified or erased, or to have processing restricted by us as data controller, or your right to object to such processing
- the existence of a right of appeal to the Austrian data protection authority as supervisory authority
- unless your personal data is collected from you as a data subject: All available information about the origin of this data
In the course of operating our websites, we commission software service providers and agencies that may gain access to your personal data in the course of their activities. They have undertaken to comply with the applicable data protection regulations vis-à-vis us. You can request more information about the service providers we commission at office@annabergerlifte.at.
Furthermore, as a data subject, you have the right to be informed whether your personal data has been transferred to a third country or to an international organisation. If this is the case, you as the data subject have the right to obtain information about the appropriate safeguards in connection with the transfer.
Right of rectification
As a data subject, you have the right to request that we correct any inaccurate personal data relating to you without delay (after you have been clearly identified by means of a valid identification document). You can contact us at any time at office@annabergerlifte.at.
Right to deletion (right to be forgotten)
As a data subject, you have the right to request from us (after being unambiguously identified by a valid identification document) that the personal data concerning you be deleted without delay, provided that one of the following reasons applies and insofar as the processing is not necessary:
- Your personal data has been collected or otherwise processed for purposes for which it is no longer necessary.
- As a data subject, you withdraw your consent on which the processing was based pursuant to Art. 6(1)(a) DSGVO or Art. 9(2)(a) DSGVO and there is no other legal basis for the processing.
- As a data subject, you object to the processing pursuant to Article 21(1) of the DSGVO and there are no overriding legitimate grounds for the processing, or as a data subject, you object to the processing pursuant to Article 21(2) of the DSGVO.
- Your personal data has been processed unlawfully.
- The deletion of your personal data is necessary for compliance with a legal obligation under Union law or the law of the Republic of Austria to which we are subject as the controller.
If one of the aforementioned reasons applies, and you are a data subject whose personal data is stored by the Annaberger Liftbetriebs Ges.m.b.H. and you wish to arrange the deletion of this data, you can contact us at any time by e-mail at office@annabergerlifte.at.
Right to restrict processing
As a person affected by the processing of personal data, you have the right to demand that we, as the controller, restrict processing (after clear identification via a valid identification document) if one of the following conditions is met:
- The accuracy of the personal data is disputed by you as the data subject for a period of time that enables us as the controller to verify the accuracy of your personal data.
- The processing is unlawful and you, as the data subject, object to the erasure of your personal data and request instead the restriction of the use of your personal data.
- We as the controller no longer need your personal data for the purposes of processing, but you as the data subject need it to assert, exercise or defend legal claims.
- You, as the data subject, have objected to the processing pursuant to Article 21(1) of the GDPR and it is not yet clear whether the legitimate grounds of the controller override those of the data subject.

Your right to data portability
As a person affected by the processing of personal data, you have the right to receive the personal data concerning you, which you as the data subject have provided to us as the controller, in a structured, common and machine-readable format. You also have the right to transfer this data to another controller without hindrance from us, provided that the processing is based on consent pursuant to Art. 6(1)(a) DSGVO or Art. 9(2)(a) DSGVO or on a contract pursuant to Art. 6(1)(b) DSGVO and the processing is carried out with the aid of automated procedures, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Furthermore, when exercising your right to data portability pursuant to Article 20(1) of the DSGVO, you as a data subject have the right to have your personal data transferred directly from us as controller to another controller, insofar as this is technically feasible and provided that this does not adversely affect the rights and freedoms of other individuals.

Right of objection
As a data subject, you have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out on the basis of Article 6(1)(e) or (f) DSGVO. To do so, you can contact us at any time at office@annabergerlifte.at.
Insofar as we process your personal data for the purpose of direct marketing, you as the data subject have the right to object at any time to the processing of personal data for the purpose of such marketing.
Right of appeal
If you are of the opinion that the data processing is not being carried out lawfully, we would first be pleased if you sought direct contact with us. Irrespective of this, as a data subject you have the right to complain to the Austrian Data Protection Authority as the supervisory authority.
